POLISH VODKA MUSEUM REGULATIONS

Article 1

Definitions

For the purposes of these Regulations, the following terms shall have the following meanings:

  1. Museum – the Polish Vodka Museum, Plac Konesera 1, 03-736 Warszawa, run by the Polish Vodka Foundation, Plac Konesera 1, 03-736 Warszawa, a non-profit organisation, fulfilling its statutory objectives.
  2. Shows – showing, visiting and lectures on the history and production of Polish vodka, using Polish vodka in bartending secrets, optionally combined with savouring events organised at the Vodka Academy Bar located on the second floor of the Museum. The objective of the Show is to promote the 600-year-long tradition and culture of the Polish alcohol industry, and specifically the tradition and culture of responsible consumption of alcohol, protecting and promoting the Polish Vodka geographical indication, conducting campaigns to increase visitors’ awareness of threats resulting from excessive alcohol consumption.
  3. Individual Visitor – an adult person and/or minor in parental or legal guardian’s custody.
  4. Group – a group of adults and/or minors in parental or legal guardian’s custody composed of at least 11 persons.
  5. Purchaser – the Individual Visitor and/or the Group who/which purchased a ticket to the Polish Vodka Museum.
  6. Visitors – the Individual Visitors and/or the Groups.
  7. System – the online booking system for tickets to the Polish Vodka Museum accessible from the website muzeumpolskiejwodki.pl.
  8. Charge – the Cash Amount due for tickets and/or services being booked. The amount is charged based on the number of services in the Visitor’s cart.
  9. Ticket – confirmation of the agreement concluded between the Purchaser and the Museum ensuring the right to attend the Show organised by the Museum. Whenever these Regulations refer to the Ticket in the singular, it shall include the plural and vice versa.
  10. Ticket Promise – promise to book the Ticket ensuring the right to attend the Show organised by the Museum. Whenever these Regulations refer to the Ticket in the singular, it shall include the plural and vice versa.

Article 2

General provisions

  1. These Regulations set forth the rules of booking and purchasing tickets for the Shows organised by the Museum, operating the Booking System and the manner of implementing an agreement between the Museum and the Purchaser.
  2. An entry ticket is valid only on the date and hour indicated thereon.
  3. When visiting, making mobile phone calls shall be prohibited.
  4. When visiting, the Visitors shall not be permitted to record video.
  5. A visit to the Museum starts at a specified time and place. A ticket holder being late for the tour shall not be admitted to visiting, his/her ticket shall be deemed invalid and he/she shall not be entitled to be admitted at any other time or reimbursed with the amount paid for the ticket.
  6. When booking the ticket online or purchasing it at the Reception Desk, the Purchaser agrees to receive alcoholic beverages-related content during the Show.
  7. Persons who are under the influence of alcohol and/or intoxicants, behaving in the manner which could pose a threat to the security of collections, prejudice the show policy or violate any generally accepted social standards shall be prohibited from entering the exhibition.
  8. Should the Visitor distort or prevent the visiting, the Museum Management may ask such Visitor to leave the Museum.
  9. The Visitor shall be financially liable for any damage caused by his/her acting.
  10. The entire Museum exhibition is monitored.
  11. In the Museum, the Visitors are requested to follow instructions of the Museum personnel and the Museum security agents.
  12. Selling the Ticket and/or the Ticket Promise to minors not being in parental or legal guardian’s custody shall not be permitted.
  13. Parents or legal guardians who purchased the ticket for the minor in their custody shall be held responsible for this minor.
  14. Minors may receive the entry Ticket after their parent or legal guardian fills in a relevant   statement form at the Museum ticket office before the Show starts.
  15. Minors shall be totally prohibited from alcoholic beverages consumption, and providing them with such beverages by their parent or legal guardian shall result in their immediate removal from the Show and in extreme cases, notifying law enforcement authorities about it.
  16. Detailed information about visiting (including the opening hours) permanent exhibitions, temporary exhibitions, temporarily unavailable areas, special events, lectures as well as guide and educational offers and also information about ticket prices is available at ticket offices,  museum information points and on the Museum website.

Article 3

Visiting days and opening hours of the Museum

Tour time

  1. The Shows for the Individual Visitors and the Groups shall be held during the days and hours indicated on the website: muzeumpolskiejwodki.pl.
  2. The Museum Management reserves the right to change the tour date and temporarily exclude some museum premises from visiting in emergency situations, and persons who provide their e-mail addresses shall be notified about it and offered a new date of the Show convenient for them or they shall be reimbursed for the purchased Tickets according to the procedure described in Article 8 hereof.
  3. During the Museum opening hours, the Shows shall be held every 20 minutes commencing from 10:00 hrs until 19:00 hrs (Sunday-Thursday) or from 11:00 hrs until 20:00 hrs (Friday-Saturday).
  4. The Show may not be attended by more than 25 visitors at a time.
  5. The Museum tour time is estimated to take approximately 60 minutes.
  6. Any tour beyond the opening hours shall be agreed on an individual basis, only for the Groups composed of minimum 10 persons, each time in reply to the Purchaser’s enquiry.

Article  4

The booking system

Technical information

  1. The system is the online system for booking tickets and purchasing the Ticket Promise for the Shows organised by the Museum. The owner of the System is the Polish Vodka Foundation, Plac Konesera 1, 03-736 Warszawa, KRS 0000593987, NIP [tax identification number]: 525-264-21-43, REGON [statistical identification number]: 363449747, further referred to as the “Museum’.
  2. To make the booking online, the following technical conditions are required to be fulfilled: the updated operating system and the latest versions of the web browser.
  3. The technical conditions for using the System directly influence the correctness of its operations and the possibility of using it by the Purchaser, and also its proper display in the web browser and the safety of data made available by the Purchaser. Any intentional and unintentional activities contrary to these Regulations shall be carried out at the Purchaser’s exclusive responsibility.
  4. Websites operate on the basis of the “cookies” technology. The principles of using “cookies” by the Museum are set out in the Privacy Policy available at the website:  muzeumpolskiejwodki.pl.

Article 5

The online booking system

  1. The online system is a free automatic service, and it enables the Individual Visitors to book and purchase the Ticket Promise and upon prior registration and contact with the Museum – for the Groups.
  2. The condition of using the online booking system shall be:
    1. accepting these Regulations which at the same time constitutes the statement of intent and creates legal obligations between the Purchaser and the Polish Vodka Museum, Plac Konesera 1, 03-736 Warszawa;
    2. following the required purchase procedures available at the website: muzeumpolskiejwodki.pl 
      1. entering the Purchaser’s data, including his/her age,
      2. choosing the date and hour of the Show as well as the number and type of tickets,
  1. checking the correctness of data having been entered,
  2. accepting these Regulations.
  1. The agreement on sale of the Ticket Promise shall be concluded by selecting the date and hour of the Show, the number and type of tickets and after providing all necessary data, accepting these Regulations and making the following payments by the Purchaser:
    1. the Charge for the Individual Visitors,
    2. the advance payment or the whole Charge for the Group.
  2. According to the Regulation of the Minister of Finance dated 26 July 2010, since selling tickets by booking and paying for them online is not subject to fiscalization, the Purchaser shall not receive a fiscal receipt.
  1. The Individual Visitor is obliged to make the payment for the Ticket Promises by the online booking system through eService allowing for various forms of online payments.
  2. The Museum reserves the right to cease the online sale at any time for important reasons.
  3. The Museum reserves the right to cancel the reservation request with incomplete or untrue data.
  4. The Museum shall not be liable for consequences of providing untrue or erroneous data on the order form and for any data transmission disruptions when making the purchase.
  5. Online payments are serviced by the firm CENTRUM ELEKTRONICZNYCH USŁUG PŁATNICZYCH ESERVICE Sp. z o.o.; 01-102 Warszawa ul. Jana Olbrachta 94, KRS: 0000490970, NIP: 1181477610, REGON: 016107240.
  6. The Purchasers are not entitled to withdraw from the agreement under the provisions of the Consumer Rights Act dated 30 May 2014 which results from the subject of the agreement and Article 38 point 12 of the Act.
  7. The Museum reserves the right to change prices of entry tickets and the ticket promise about which it shall inform on the website muzeumpolskiejwodki.pl.

Article 6

Principles for purchasing tickets at the ticket office of the Polish Vodka Museum

  1. The Individual Visitor may purchase, on a one-off basis, the Tickets for not more than 9 persons.
  2. To purchase the Ticket it shall be necessary to hold an identity card confirming the Individual Visitor’s age.
  3. Should no identity card confirming the Purchaser’s age be held, such person may not exercise the option of free and/or payable savouring.
  4. Only the Museum Manager or a person authorised by the Museum Management may decide on withdrawing from the provisions in points 2 and 3 above.
  5. The Shows shall be held in Polish and in English according to the time schedule available on the website muzeumpolskiejwodki.pl or at the Museum ticket offices.
  6. The Shows with the additional translation into German, French, Russian and Spanish may be booked by phone on +48224193150 or e-mail at recepcja@pvm.pl.
  7. The Museum reserves the right to combine the Individual Visitors with the Groups should the number of all the visitors not exceed 25 persons.
  8. It is possible to ensure the exclusivity of the Show for the Individual Visitors. A fee for such Show shall be calculated on an individual basis, and it may not be lower than PLN 100 per person.
  9. Card payments made at the Museum ticket offices are serviced by the firm CENTRUM ELEKTRONICZNYCH USŁUG PŁATNICZYCH ESERVICE Sp. z o.o.; 01-102 Warszawa ul. Jana Olbrachta 94, KRS: 0000490970, NIP: 1181477610, REGON: 016107240.

Article 7

Group reservations

  1. The Purchaser may make a one-off booking for an organised Group composed of not less than 10 and not more than 25 persons.
  2. The Museum reserves the right to combine the Individual Visitors with the Groups should the number of all the visitors not exceed 25 persons.
  3. It is possible to ensure the exclusivity of the Show for the Groups. A fee for such Show shall calculated on an individual basis.
  4. The Groups with the pre-paid or fully paid reservations shall be entitled to 1 free entry ticket for the leader of the group composed of minimum 15 persons.
  5. With respect to the Group of persons with disabilities, the Purchaser shall be entitled to receive the statutory number of free entry tickets for the group leaders.
  6. The Purchaser may chose the language of the Show (German, English, French, Spanish, Polish or any other should the Museum be in position to ensure a relevant guide).
  7. The Museum allows the possibility of making the Show in 2 languages only for the expected Groups which paid the Charge.
  8. Making the reservation for the organised Group obliges the Purchaser to make the advance payment to the Museum in the amount of 50% of the value of the total  Charge within 5 days as of the date of making the reservation to the bank account 91 1030 1508 0000 0008 1819 1006, for the Polish Vodka Foundation, ul. Złota 59; 00-120 Warszawa; NIP: 525 264 21 43; providing the reservation number in the transfer title.
  9. Failure to make the advance payment within 5 days as of the booking date shall result in the total cancellation.
  10. The Purchaser is obliged to pay the additional amount of the lacking booking amount at the Museum ticket office not later than 20 minutes before commencing the Show to which he booked tickets.
  11. The Purchaser may pay the total amount of the Charge for tickets. The payment should be made by bank transfer to:

providing the reservation number in the transfer title.

  1. After the whole booking amount is paid and the Museum verifies it, the Purchaser shall receive electronically the confirmation of purchasing entry tickets to the Museum which are to be collected at the Museum Reception Desk.
  2. Should there be less than 5 days between the booking date and the Show date, the Purchaser shall pay for the tickets at the Museum ticket office. It may also pay the whole amount by bank transfer. The payment should be made by bank transfer to:

providing the reservation number in the transfer title.

  1. After the whole booking amount is paid and the Museum verifies it, the Purchaser shall receive electronically the confirmation of purchasing entry tickets to the Museum which are to be collected at the Museum Reception Desk.
  2. The Groups which do not make the advance payment are obliged to arrive to the Museum 20 minutes before the Show, for which they booked tickets, commences. Failure to meet this deadline may result in selling tickets booked by the Group.

Article 8

Changes in the purchased Tickets and the Ticket Promises for the Individual Visitors

  1. The Museum shall not reimburse for the Tickets having been purchased.
  2. In specific cases the purchased Tickets may be exchanged for the Tickets with another Show date about which the Museum Manager or a person authorised by the Museum Management shall decide each time.
  3. Should the date of the visiting be cancelled or changed or some of the Museum premises be temporarily excluded from the visiting in emergency situations or visiting hours be changed, the Museum shall immediately inform the Purchasers about this fact. Should it be the case, the Purchaser shall be entitled to change the Ticket into another one or be reimbursed for the price paid for the Ticket. To be reimbursed for the paid price, the Purchaser shall be obliged to send a relevant information to the address: recepcja@pvm.pl. The amount paid for the Ticket shall be reimbursed by bank transfer or by card at the Museum ticket office immediately, however, not later than within 14 days as of the date of receipt of all data necessary for such reimbursement to be made.

Article 9

Cancelling the booking or changing the number of visitors for the Groups

  1. The Museum provides for the possibility of free cancellation of the reservation within 45 days before the planned Show.
  2. Should the pre-paid or fully paid reservation be cancelled within the time limit of up to 30 days before the planned Show, the Museum shall charge a penalty fee in the amount of 20% of the total Charge.
  3. Should the pre-paid or fully paid reservation be cancelled within the time limit of up to 15 days before the planned Show, the Museum shall charge a penalty fee in the amount of 50% of the total Charge.
  4. Should the pre-paid or fully paid reservation be cancelled within the time limit of up to 7 days before the planned Show, the Museum shall charge a penalty fee in the amount of 100% of the total Charge.
  5. For your convenience, we provide for the possibility to cancel the reservation or change the number of visitors up to 30 days before the Show.
  6. The number of participants in the Group may be increased only if there are available seats left for a given Show.
  7. The difference resulting from the provisions of points 2,3 and 4 hereof shall be paid by bank transfer to the bank account number indicated by the Purchaser within the time limit not longer than 14 days as of the date of receiving all data necessary for the reimbursement to be made.

Article 10

Personal data protection

  1. The personal data processing in the meaning of the Act dated 29 August 1997 on Personal Data Protection in relation to rendering services by electronic means shall be governed by the provisions of this Act, unless the provisions of the Act dated 18 July 2002 on the provision of services by electronic means stipulate otherwise.
  2. The Museum shall collect and process personal data of the Purchasers to the extent necessary to implement the Agreement.
  3. The data controller shall be the Polish Vodka Foundation, Plac Konesera 1, 03-736 Warszawa, KRS 0000593987, NIP: 525-264-21-43, REGON: 363449747.
  4. When making the registration in the System, the Purchaser shall consent to process his/her personal data by the Museum to implement the Agreement and handle returns and complaints. Providing such data is voluntary. Failure to provide data requested by the System shall result in the lack of possibility to conclude the agreement.
  5. The Purchaser may access his/her personal data, correct it and monitor the processing of data being subject to it, on the principles set out in Article 32 par. 1 of the Personal Data Protection Act dated 29 August 1997 (uniform text in Journal of Laws of 2002, No. 101, item 926, as amended).

Article 11

Procedure and manner of lodging complaints

  1. The Purchaser shall be entitled to lodge a complaint by electronic mail to the address: contact@pvm.pl, by post or in person at the registered office of the Museum.
  2. Complaints shall be examined within 30 days. A reply shall be sent by e-mail or by post.
  3. The Museum is willing to settle amicably any disputes arising in connection with concluding and implementing the Agreement.

Article 12

Amendments to the Regulations

  1. These Regulations are available at the website muzeumpolskiejwodki.pl, at the ticket offices of the Museum reception desk and in the office of the Polish Vodka Museum: Plac Konesera 1; 03-736 Warszawa.
  2. The Museum may amend all the provisions of these Regulations at any time without providing reasons thereto. Such amendment shall be published on an ongoing basis in the form of the uniform text of the Regulations available at the main page of muzeumpolskiejwodki.pl with a relevant information about it.
  3. After the information about amending the Regulations is published on the main page of muzeumpolskiejwodki.pl, the User should immediately read any such amendment because making the reservation after such publication shall be understood as the unconditional acceptance of the new content of the Regulations by the User.

Article 13

Final provisions

  1. Any agreements concluded on the basis of these Regulations shall be governed by Polish law.
  2. Orders made during the term of the previous version of the Regulations shall be fulfilled according to the provisions thereof.
  3. Any disputes between the Museum and the Purchaser being the consumer in the meaning of Article 221 of the Civil Code shall be settled by competent common court in accordance with the Code of Civil Procedure.
  4. Any disputes between the Museum and the Purchaser being no consumer in the meaning of Article 221 of the Civil Code shall be settled by common court having jurisdiction over the registered office of the Museum.
  5. The provisions of commonly binding laws shall apply to matters not regulated by these Regulations.
  6. These Regulations shall neither exclude nor limit any Purchaser’s rights vested with him/her by force of the absolutely binding provisions of law. In the case of any controversies between the provisions of these Regulations and the absolutely biding provisions of law granting such rights, these provisions shall prevail.
  7. The purchase of tickets through the System shall be construed as accepting these Regulations.
  8. With respect to travel agencies and/or other entities which signed the agreement with the Museum, these Regulations shall constitute an annex to any such agreement, and the purchase of tickets through the System shall be construed as their acceptance.
  9. The Polish Vodka Museum of which operator is the Polish Vodka Foundation follows the principle of responsible acting and does not promote alcohol consumption, but it is only engaged in educational activities related to the history and culture of Polish vodka.
