TERMS AND CONDITIONS CONCERNING SALES AND VISTNG THE POLISH VODKA MUSEUM

 

Art.1 

Defined terms

 

For the purposes of these Terms and Conditions, the following phrases have the following meanings:

 

Museum – Museum of Polish Vodka with its registered office in Warsaw Plac Konesera 1, 03-736 Warsaw, run by the Fundacja Polska Wódka with its registered office in Warsaw Plac Konesera 1, 03-736 Warsaw, entered into the National Court Register, kept by the District Court for the Capital City of Warsaw, XIII Commercial Division of the National Court Register under KRS number: 0000593987, NIP: 5252642143, REGON: 36344974700000 Non-Profit organization.

Show – a screening, visit, and lecture concerning the history and production of Polish Vodka as a Protected Geographical Indications, the use of Polish Vodka in the art of bartending, optionally combined with a tasting organized in the Akademia Wódki Bar located on the second floor of the Museum. The aim of the Show consists in promoting the 500-year-old tradition and culture of the Polish alcohol industry, especially the tradition and culture of responsible alcohol consumption, protecting and promoting the Polska Wódka/ Polish Vodka Protected Geographical Indication; conducting awareness campaigns concerning the dangers of excessive alcohol consumption.

Individual Guest – an adult who possesses an entrance ticket to the Museum.

Group – a group of adults, of at least 25 people.

Visitors – individual Guests and/or Groups.

Ticket – confirmation of an Agreement concluded between a Customer and the Seller ensuring the right to participate in the Show.

Voucher – a single-purpose voucher including a unique code, a specific nominal value and an expiry date, which can be exchanged for a Ticket for a selected Show, if available.

Museum Ticket Office – a place at the Museum's registered office where Tickets and Vouchers are sold.

System – an online sales service available at: www.muzeumpolskiejwodki.pl, enabling the purchase of Tickets, Vouchers, as well as Products and Services offered in the Store owned by the Seller.

Store – an element of the System in which Products and Services are sold, available at www.muzeumpolskiejwodki.pl.

Seller - Fundacja Polska Wódka, with its registered office in Warsaw, Plac Konesera 1, 03-736 Warsaw, entered into the register of entrepreneurs kept by the District Court for the Capital City of Warsaw – XIII Commercial Division of the National Court Register under KRS 0000593987, NIP: 525-264-21-43, REGON: 363449747.

Customer – an adult natural person, a legal person, or an organizational unit without legal personality, which, under the conditions indicated in the Terms and Conditions, uses the System and/or purchases Tickets, Vouchers, Products, and Services via the System or purchases Tickets and Vouchers at the Ticket Office at the Museum's registered office

Product - a product available in the Store's offer.

Order - the Customer's declaration of intent leading directly to concluding a Sales Agreement.

Service - a customization service available in the Store and concerning selected Products consisting in engraving an inscription on a Product constituting the subject of the Sales Agreement.

Cart - an element of the System in which Tickets, Vouchers, Products, and Services selected by the Customer are visible.

Registration - the procedure for creating an Account by a Customer.

Account - an element of the Store created by a Customer through Registration, where data provided by a Customer is collected, including information concerning Orders.

Order Processing Time - Order completion Time (does not include delivery time).

Sales Agreement - an agreement for the sale of Tickets, Vouchers, Products, and Services within the meaning of the Act of April 23, 1964 – Civil Code, concluded in accordance with the provisions of these Terms and Conditions between the Seller and the Customer, via the System.

Consumer - a natural person performing a legal action with the entrepreneur which is not directly related to its business or professional activity;

 

Art.2

General provisions

 

  1. These Terms and Conditions define the principles for visiting the Museum, using the online sales System and the Store run by the Seller at www.muzeumpolskiejwodki.pl, as well as the principles and procedure for concluding Sales Agreements with a Customer at a distance via the System.
  2. The Seller is the operator of the System.
  3. The Terms and Conditions are available at the www.muzeumpolskiejwodki.pl website an at the Seller's registered office, at the Museum of Polish Vodka, Plac Konesera 1, 03-736 Warsaw.
  4. Before a transaction is completed it is necessary to accept these Terms and Conditions in the System by checking a given box at the end of the Order and in the process of creating an Account, and before making a payment for a Ticket at the Museum Ticket Office.

 

Art.3

Principles of sales via the system

 

Contact with the Seller

 

  1. The Customer may contact the Seller via traditional mail, directing correspondence to the following address: Fundacja Polska Wódka, Pl. Konesera 1, 03-736 Warsaw and especially by e-mail and telephone, as indicated in section 2 below.
  2. Contact in matters concerning sales of:

    2.1. Tickets and Vouchers:

  3. The Customer may contact the Seller by phone during the days and hours of the Museum's opening referred to in § 10.

 

Account in the System

 

  1. It is possible to perform a purchase in the System via a created Account referred to in section 2 below, or without the need to create an Account, providing only the necessary information.
  2. In order to create an Account in the System, it is necessary to complete the Registration Form available at: www.muzeumpolskiejwodki.pl.
  3. Creating an Account in the System is free.
  4. During the Registration process, the Customer voluntarily provides own personal data, in particular: name, surname, and e-mail address. Personal data will be processed in accordance with the provisions of § 12.
  5. Logging in to the Account is done by providing the Login and Password, which were previously Established by the Customer in the Registration Form.
  6. The Customer, at any time, can delete the Account by sending a proper request to the Seller, without giving a reason and without incurring any fees, in particular by e-mail or in writing to the addresses provided in Point I, sections 1 and 2 above.

 

Technical information

 

  1. To use the System, including viewing the offer and placing Orders, it is necessary to meet the following technical requirements: possessing an updated web browser allowing to display websites, current operating system, access to the Internet and having an e-mail box with an active e-mail address, and in the case of purchasing Tickets, additionally possessing a printer or mobile device that meets the conditions for properly displaying the Ticket. It is recommended to use browsers with the "cookies" option enabled.
  2. Technical requirements referred to in art. 1 above have a direct impact on the proper functioning and the possibility of using the System by the Customer, as well as its correct appearance in the web browser and the security of data provided by the Customer. Any intentional or unintentional actions contradictory to the Terms and Conditions are performed at the sole responsibility of the Customer.
  3. Online sales of Tickets, Vouchers, Products, and Services are available around the clock, excluding technical breaks that are announced on the website.

 

 

Purchases in the System

 

  1. In one transaction, it is possible to perform a simultaneous purchase of Tickets, Vouchers, Products and Services.
  2. Purchasing Tickets, Vouchers, Products, and Services in the System is possible after Registering in accordance with the provisions of Point II above or by skipping the process of creating an Account, by providing the necessary personal and address data enabling the implementation of the Order.
  3. By adding Tickets to the Cart, the Customer is obliged to choose the type and number of Tickets as well as the expected, available date and time of the Show to which the Ticket relates, as referred to in § 9, section 1 below.
  4. Purchasing a Ticket in the System for a given date and time is possible up to 10 minutes before the planned Show.
  5. All information in the System concerning Tickets, Vouchers, Products, and Services, including the provided prices, do not constitute a commercial offer within the meaning of Art. 66 of the Civil Code, but an invitation to conclude an agreement specified in Art. 71 of the Civil Code.
  6. Completing an Order is carried out by adding Tickets, Vouchers, Products, and Services to the Cart using the "Add to cart" button. After completing an Order, the Customer is obliged to choose the method of delivering the Order, the form of payment, and in the case of choosing courier shipping, provide the shipping address and data.
  7. Before placing the final Order, the Customer has the option of modifying it in the Cart. After placing an Order, modifying the Order is possible only through direct contact with the Seller via the contact details referred to in Point I, sections 1 and 2 above, but no later than by the time the Order is shipped.
  8. An Order added to the Cart will be stored in it for 30 minutes. After this time, the Order will be automatically cancelled.
  9. Changes in an Order including personalized Products may be made by the Customer until carrying out the engraving on the Product.
  10. VAT invoices are issued at the Customer's request. In this case, the Customer is obliged to register and create an Account.
  11. Concluding a Sales Agreement takes place at the moment of approving and paying for an Order.
  12. By clicking the "Buy and pay" button, the Customer undertakes to pay for the Order.
  13. Payments are made via the Tpay payment operator, owned by the company: Krajowy Integrator Płatności S.A., ul. Św. Marcin 73/6, 61-808 Poznań, KRS: 0000412357, NIP: 7773061579, REGON: 300878437.
  14. In the event of not performing the payment within 20 minutes of placing an Order, the Order will be automatically cancelled, about which the Customer will be informed in a separate e-mail.
  15. In accordance with the Regulation of the Minister of Finance of July 26, 2010, the sale of Tickets and Vouchers in the scope of ordering and payment via the Internet is not subject to fiscalization, therefore, the Buyer does not receive a fiscal receipt.
  16. The Store is not responsible for consequences resulting from providing false or incorrect data in the Order form and for errors in the payment system referred to in the section 13 above.

Art.4

Prices

 

  1. Current prices of Tickets, Vouchers, Products, and Services are published at www.muzeumpolskiejwodki.pl, they are gross prices (including VAT), are expressed in Polish zlotys, and do not include delivery costs.
  2. The Store reserves the right to freely change the prices of Tickets, Vouchers, Products, and Services, with the exception of the prices of Tickets, Vouchers, Products, and Services paid for in Orders.

Art.5

Order Processing Time and Delivery

 

  1. Orders for Products and Services are carried out on the territory of the Republic of Poland.
  2. Tickets and Vouchers purchased via the System are delivered to the Customer to the e-mail address provided when placing an Order.
  3. The Store offers the following forms of delivering Products:
    3.1. Courier,
    3.2. Personal collection at the Seller's stationary store, located at the Museum of Polish Vodka, Pl. Konesera 1, 03-736 Warsaw.
  4. The Customer chooses the form of delivery and accepts its costs in the process of approving the Order.
  5. The order will be processed after the funds are credited to the Seller's account.
  6. The approximate Order Processing Time is up to 3 business days. Implementation in exceptional cases, it may be extended, about which the Seller will inform the Customer in electronic form to the e-mail address provided in the Order.
  7. Personal collection of the Order is free of charge and possible within 14 days from the moment of informing the Customer about the possibility of collecting the Order. After this date, the Seller will contact the Customer via the e-mail address provided in the order, in order to determine the following procedure.
  8. The Order delivery time in Poland depends on the provider of shipping services selected in the Order, and is a maximum of 30 days from the date of concluding the Agreement. If this deadline is exceeded, the Seller will propose a new delivery date, although, the Customer who is a Consumer has the right to demand cancelling the Order by issuing a statement in writing or electronically, as well as demand a refund of the amount paid.
  9. The Order delivery time may especially be extended if the delivery address provided by the Customer is incorrect (incomplete, includes errors) or if the Order includes a Service and the Customer has not provided the data necessary to perform it.
  10. The Seller will contact the Customer to clarify the irregularities or lack of data in the Order by e-mail to the e-mail address provided in the Order. The Order Processing Time in this case is counted from the date when the Customer confirms the correct data for shipment/data for the Service.
  11. In the case of delivering via courier, the Customer is obliged to verify the shipment in the presence of a representative of the carrier, and if the Customer suspects that the parcel is damaged, draw up a damage report and immediately send it together with a possible complaint to the Seller.

Art.6

Withdrawal from a Sales Agreement

 

  1. The Consumer may withdraw from a Sales Agreement within 14 days without providing a reason, by submitting a proper statement in writing, with the provision that the right to withdraw from a distance agreement is not entitled to the Consumer in relation to Tickets, Customized Products, and Services.
  2. The time limit specified in paragraph 1 begins with delivering the Order to the Consumer or a person indicated by the Customer.
  3. To comply with the time limit set out in section 1 it is sufficient to send a statement before its expiry. The statement should be sent via traditional mail or electronically by sending: (i) a statement including an electronic signature confirmed by a trusted profile or a qualified signature, or (ii) a scanned statement with the Customer's signature to the Seller's e-mail address. The statement can be submitted on a form, the template of which can be downloaded from the muzeumpolskiejwodki.pl website in the Shop tab under the Terms and Conditions.
  4. In the event of withdrawal from a Sales Agreement, the Seller returns all payments received to the Consumer to the payment card or account number from which the payment was made, including the costs of the cheapest delivery available when placing the Order, immediately, but not later than 14 days from the date on which the Seller was informed about the decision to withdraw from the Sales Agreement.
  5. The Consumer is obliged to return the Product to the Seller, no later than within 14 days from the date on which that person withdrew from the Sales Agreement. What counts is the date of sending the Products to the Seller. The Consumer has the possibility to return the Products at person in the Seller's stationary store located in the Museum of Polish Vodka, Pl. Konesera 1, 03-736 Warsaw.
  6. It is possible to return only a new Product that does not include any features that indicate its use.
  7. In case of withdrawal from a distance agreement, the direct costs of returning the Product to the Seller are borne by the Customer.

Art.7

Product Complaints

 

  1. A Sales Agreement consists in new Products.
  2. The Seller provides Products without defects.
  3. The Seller is liable to the Customer if the Product includes a physical or legal defect (warranty). In the event that the Product includes a defect, the Customer may submit a request to reduce the price, withdraw from the Sales Agreement, or demand replacing the defective Product with one free from defects, or removing the defect.
  4. Complaints concerning Products should be submitted via e-mail at: sklep@pvm.pl, by post, or in person at the Seller's registered office.
  5. A complaint should include:

    a) name and surname of the person submitting the complaint,

    b) the content of the complaint, in particular a description of the defect and the request referred to in section 3 above,

    c) the date of placing and receiving the Order,

    d) photographic documentation of defects or grounds for complaint.

  6. As part of considering the complaint by the Seller, in accordance with the information received from the Seller, the Products to which the complaint relates should be sent back to the Seller's address along with a proof of purchase.
  7. The Seller has 14 days to respond to the Customer's complaint.
  8. The Seller shall notify the Customer about considering the complaint and the result in a message sent to the correspondence address or e-mail address provided by the Customer in the complaint.

Art.8

Detailed principles of using tickets

 

  1. In order to purchase a Ticket at the Ticket Office, it is necessary to have an identity card confirming the Customer's age. In the event that the Ticket was purchased via the System, the Customer's age will be verified by the Museum staff immediately before the planned Show.
  2. In the absence of an identity card confirming the age of the Guest, the Guest will not be able to take advantage of the tasting option and/or the additionally paid tasting, which is part of the Show, and for which the Customer is not entitled to a reduction in the price of the Ticket.
  3. It is not allowed to sell Tickets to minors.
  4. The shows are carried out in Polish and English according to the schedule available at www.muzeumpolskiejwodki.pl or at the Ticket Office.
  5. In order to determine the possibility of organizing a Show with an additional translation in German, French, Russian, Spanish, or Italian, the Customer should contact the Museum Ticket Office by phone at +48 22 4193150 or by e-mail at: recepcja@pvm.pl, at least 5 days before the planned Show. The Museum will inform the Customer individually about the possibility of purchasing Tickets for Shows referred to above.
  6. The Museum reserves the right to combine individual Guests with Groups if the sum of all visitors does not exceed 25 people.
  7. A Ticket or Voucher purchased through the System or at the Museum Ticket Office is not refundable.
  8. To use a voucher, please contact the Reception and attach the voucher number or QR code to the reservation. Lack of this data will make it impossible to make a reservation.
  9. A voucher not used within the booking period expires.
  10. Terms and Conditions concerning vouchers also apply to vouchers purchased from the Museum's Business Partners: Get Your Guide, Tickets.com, Groupon, Katalog Marzeń, Superprezenty.
  11. It is possible to guarantee the exclusivity of the Show for Individual Guests and Groups. The remuneration for conducting a Show in such a case is valued individually.
  12. For Tickets and Vouchers at the Museum Ticket Office, the Customer may pay in cash or by card. Payments by card at the Museum Ticket Offices are handled by the Tpay payment operator, owned by Krajowy Integrator Płatności S.A., ul. Św. Marcin 73/6, 61-808 Poznań, KRS: 0000412357, NIP: 7773061579, REGON: 300878437.

Art.9

Visiting rules

 

  1. The shows are intended for adults.
  2. Minors may participate in the Shows solely at the responsibility of their parents or legal guardians.
  3. A Ticket entitles to a single entry, at the date and time indicated on it.
  4. During the tour, it is forbidden to make phone calls using mobile phones.
  5. During the tour, it is forbidden to record video materials.
  6. Visiting the Museum begins at strictly defined times and in a designated location. An owner of a Ticket who is late for a Show that has already started will not be allowed to visit, the Ticket will be considered invalid, and its holder will not be entitled to participate in the Show at another time or to a refund of the amount paid.
  7. A Customer possessing a Ticket purchased in the System is obliged to present the Ticket before the planned Show, in the form of a legible printout or on a mobile device allowing to correctly read the data on the Ticket, especially a unique code assigned to the Ticket.
  8. Before starting the Show, the Visitor will receive a disposable wristband, marked with a proper colour depending on the type of Show or depending on whether the person participates in the tasting referred to in § 1, section 2.
  9. By purchasing a Ticket, the Customer agrees to receive content related to alcoholic beverages during the Show.
  10. Intoxicated persons and/or under the influence of intoxicating substances, persons behaving in a manner that could endanger the safety of the collection, disturb the order of the Show, as well as violate generally accepted standards of behaviour in public places are forbidden to enter the exhibition.
  11. In the event that a Visitor disturbs or prevents the performance of the Show, the Museum Management reserves the right to order the visitor to leave the Museum.
  12. During the Show it is strictly forbidden to consume food or drink. In the case of a breach of this prohibition, the museum staff has the right to take appropriate action, including the expulsion of the Visitor from the Show.
  13. The Visitor bears material responsibility for damage caused during the Show.
  14. On the premises of the Museum, the instructions of the Museum staff and employees of the Museum's security services should be followed.
  15. Minors participating in the Show only under the supervision of adults are the responsibility of parents or legal guardians.
  16. Minors are strictly forbidden to consume alcoholic beverages. Failure to comply with the rule referred to above and/or providing an alcoholic beverage to a minor by a parent or guardian will result in immediate removal from the Show, and in extreme cases notifying the competent law enforcement authorities.
  17. Detailed information concerning the tour, and especially the current opening days and hours, permanent exhibitions, temporary exhibitions, temporarily inaccessible interiors, special events, lectures, as well as the guided and educational offer, as well as information concerning current Ticket prices, is available at the Ticket Office at the Museum's registered office, external information points, and at: www.muzeumpolskiejwodki.pl

 

Art.10

Visiting time and the museum's opening days and hours

 

  1. Shows for Individual Guests and Groups take place on days and times updated at www.muzeumpolskiejwodki.pl, in the "Plan a visit" tab. Information concerning the current days and times of the Shows can also be obtained at the Museum Ticket Office.
  2. In urgent cases, the Museum's Management reserves the right to change the date of the visit and temporarily exclude some of the museum rooms from visiting, and the persons who have provided e-mail contact will be notified about it and are going to be offered a new date of the Show convenient for them or will receive a refund for the purchased Tickets.
  3. The shows start every 20 minutes during the museum's opening hours, referred to in section 1 above.
  4. The time of visiting the Museum is estimated at 80 minutes.
  5. A visit on dates outside the opening hours of the Museum is determined individually, only for Groups and each time in response to the Customer's request.

 

Art.11

Complaints and changes in purchased tickets

 

  1. The Customer is entitled to lodge a complaint in connection with the purchased Ticket or Voucher, via e-mail to the following e-mail address: recepcja@pvm.pl, by post, or in person at the Museum's registered office.
  2. Complaints referred to in section 1 above are considered within 30 days from the date of receiving the complaint. The response is sent to the indicated e-mail address or correspondence address.
  3. The purchased Tickets and Vouchers are non-refundable, non-returnable or valid.
  4. In these cases, the Purchased Tickets and / or Vouchers may, in special cases, be exchanged for a different date of the Show, which will be decided each time by the Museum Manager or a person authorized by the Museum Management.
  5. In the event of cancelling or changing the date of the Show as well as temporarily excluding some of the museum rooms from visiting, in urgent cases, the Museum will immediately inform the Customer about this fact. In such a case, the Customer will have the right to exchange the Ticket for a Show at another time or to refund the amount paid for the Ticket. In order to receive a refund referred to above, the Customer is obliged to send relevant information to the following e-mail address: recepcja@pvm.pl or by post to the address of the Museum's registered office. Refunding the funds for a Ticket will be carried out by bank transfer to the account number provided by the Customer or to the payment/credit card, which the Customer used to perform the payment immediately, but no later than within 14 days from the date of receiving the complete necessary data to make a return.
  6. In urgent cases, the Head of the Museum decides on the possible refunds of the amount for purchased Tickets.

Art.12

Personal Data Protection

 

  1. The Customer's personal data is processed by the Seller as the Administrator of personal data, for purposes related to the actions made by the Customer to conclude the Sales Agreement or in connection with concluding a Sales Agreement.
  2. Processing the Customer's personal data will take place on the terms provided for in Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and in the Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2018.1000 of 2018.05.24 as amended).
  3. The basis for the processing of personal data consists in the consent to the processing of personal data.
  4. Providing personal data by the Customer is voluntary, but necessary to create an Account and/or conclude a Sales Agreement.
  5. In the event that the Customer uses the method of delivery by courier, the Administrator shares the collected personal data of the Customer with a selected intermediary performing the shipment at the request of the Administrator. In the case of a Customer who uses the electronic payment method, the Administrator makes the collected personal data of the Customer available to the entity handling the above mentioned payments in the System.
  6. The Customer has the right to rectify data, delete data, limit data processing, transfer data, object, and withdraw consent to further data processing at any time.
  7. All requests and inquiries concerning the processing of personal data may be reported by the Customer to the Administrator by phone or in writing, especially to the following e-mail addresses: recepcja@pvm.pl or sklep@pvm.pl.
  8. The Museum's website operates on the basis of "cookies". The principles of using "cookies" as well as detailed information concerning data protection can be found in the "Cookie Policy" and "Privacy Policy" published on the muzeumpolskiejwodki.pl website.
  9. The Customer may voluntarily agree to receive commercial information from the Seller to a provided e-mail address.

Art.13

Amendments to the terms and conditions

 

  1. These Terms and Conditions are published at www.muzeumpolskiejwodki.pl and available at the Museum Ticket Office.
  2. The Seller reserves the right to amend these Terms and Conditions at any time.
  3. Amendments to the Terms and Conditions shall apply to the Customer upon acceptance of the new content of the Terms and Conditions when logging in to the System, if the Customer has created an Account before the amendments to the Terms and Conditions are implemented.
  4. Amendments to the Terms and Conditions do not apply to orders placed before the entry into force of the updated version of the Terms and Conditions. In such a case the Order is carried out in accordance with the provisions of the Terms and Conditions in force at the time of placing the Order by the Customer.

Art.14

Final Provisions

 

  1. Agreements concluded on the basis of these Terms and Conditions shall be governed by the provisions of the law generally applicable in the Republic of Poland.
  2. The Seller initially expresses its readiness to settle any disputes that may arise in connection with the conclusion and implementation of the Agreement amicably, taking into account the possibility for the Customer to exercise the right to out-of-court methods of handling complaints and pursuing claims in accordance with applicable law.
  3. Any possible disputes arising between the Seller and a Customer who is a Consumer within the meaning of Art. 221 of the Civil Code, which cannot be resolved on the principles set out in section 2 above, will be decided by the common court competent in accordance with the provisions of the Code of Civil Procedure.
  4. Any possible disputes arising between the Seller and a Customer who is not a Consumer within the meaning of Art. 221 of the Civil Code, which cannot be resolved on the principles set out in section 2 above, will be decided by a common court competent for the registered office of the Seller.
  5. In matters not covered by these Terms and Conditions, the provisions of generally applicable Polish law, in particular the Civil Code and the Act on Consumer Rights, shall apply.
  6. The Terms and Conditions do not exclude or limit ant rights of the Customer being also a Consumer, which the Customer exercises on the basis of directly binding provisions of law. In the case of any contradiction between the provisions of these Terms and Conditions and directly binding provisions of law which give the Consumers rights, the provisions of law shall prevail.
  7. Purchasing Tickets, and Vouchers, Products, and Services is tantamount to accepting these Terms and Conditions, and especially the rules applicable during the visit.
  8. In the case of organized Groups, the terms of selling Tickets will be determined individually, each time at the Customer's request, on the basis of bilateral agreements for cooperation.
  9. The Museum of Polish Vodka, operated by the Foundation, applies the principle of responsible action and does not promote alcohol consumption, but only conducts educational activities related to the history and culture of Polish Vodka.
